2. What terms, conditions and rules apply to the competitions that I enter?
These terms and conditions together with any specific rules set out in Competition Notices (as defined below) apply to all competitions offered by us. Any persons who breach them may be excluded from access to competitions. Please note that these terms and conditions apply to competitions that appear in UKTV programming time and in commercial (i.e. advertising) airtime on our channels.
The terms and conditions of any third party supplier may apply and must be accepted and complied with by the Prizewinner. These shall include compliance with any health and safety regulations which apply whilst the Prizewinner is being filmed or taking part in other promotional activity.
However as each competition is different and operates in a different way, they will each have some terms and conditions that apply only to them and these will be set out in a notice included on the page for such competition (the "Competition Notice") and are incorporated into these terms and conditions. The following general terms also apply. In the event of conflict between these terms and conditions and the Competition Notice, the Competition Notice shall prevail.
You must be a UK resident to enter a competition.
Entries must be received within the competition period indicated in the competition information. Any entries received before or after this period will not be entered. Entries delayed by postal strike or for any other reason which are not received within the competition period will not be valid.
All entrants must be over 18 years of age at the point of entry, unless otherwise stated.
Employees (including family members) of UKTV, (or its group Companies) or any prize provider - We're afraid you are excluded from entering and your entry will not be considered.
Travel, accommodation, expenses, charges and travel insurance are not included as part of any prize unless we tell you otherwise. We strongly recommend you purchase insurance for all activity prizes.
If your prize involves foreign travel please ensure that you hold a full & valid passport. We can't accept liability for failure to travel due to your invalid passport or other necessary travel documentation and visas.
In the event of any dispute regarding these terms and conditions, the Competition Notice, conduct, results or any fault, misunderstanding, mistake or dispute concerning the operation of a competition, including the correctness or acceptability of any answers given by winners, or the operation of any technical/communications system, our decision shall be final.
3. How do I enter a competition?
You can generally enter our competitions by either text messages from your mobile, red button on digital satellite or by calling from your landline telephone. In all our competitions there will be free entry routes made available and you will be offered a genuine choice to enter by post and email or via a website without payment.
For free entry, no purchase or payment is necessary to be made by you. You may unless notified otherwise in any particular competition, enter by sending your answer, name and telephone number written clearly on a postcard to the PO Box address stated in the Competition Notice.
Please state clearly which competition you are entering and include your name and contact details. Entries sent by post must reach us by the specified closing date and time for entries as specified in the Competition Notice.
Each individual competition will tell you how you can enter in that particular case and provide you with the relevant telephone numbers, mobile shortcodes, instructions regarding use of red button and PO Box numbers to use. We set out below the details that generally apply to each route of entry to make clear what is involved.
You can enter as many times as you wish unless otherwise stated in the Competition Notice but automated bulk entries will be disqualified. Where a winner has been selected and UKTV discovers or has reasonable grounds to believe a winning entry has been made via an automated bulk entry, UKTV shall have the absolute discretion to select an alternative winner. Any further entrant will be selected on the same criteria as the original entrant and will be subject to these terms and conditions.
4. How much will it cost me to enter a competition?
4.1 Before you enter one of our competitions on one of our channels, you will always be told clearly how much it will cost you. The cost for all routes of entry for each competition will be clearly stated in the Competition Notice.
However on many occasions there will be additional charges added by mobile phone or other telephone network operators which obviously we do not control. So if you need to know the total cost you will end up paying, you will need to check whether your telephone network operator will add his charges to ours and what those charges are.
5. How do I pay to enter a competition?
If you are a pre-pay mobile user, the charges will come out of your credit balance. If you pay periodic bills for your telephone, they will appear on your next bill or statement.
If you enter via digital satellite red button, the charges will appear on your next telephone bill or statement
6. Winner Selection and Prizes
Winners are selected at random from all correct entries received by the stated closing date by a closed computer generated system. We will have the final overall decision over winner selection and this decision is final. No correspondence will be entered into.
All correct entries have an equal chance of selection regardless of method of entry.
If you are the winner, you will be notified via email or telephone within 28 days of the competition closing date.
Please allow 28 days for delivery of your prize from the date you successfully claim your prize.
We won't be liable if any prize fails to reach you or you cannot take it for reasons beyond our control, or if any prize is damaged during delivery.
You will have a specified period to claim your prize. This specified period will be detailed in the Competition Notice. UKTV will attempt to contact you up to three times within this specified period. If you do not respond within the stated time period, you may forfeit your prize. We reserve the right to award the prize to another winner if we are unable to make contact with you on the telephone number or details provided. Any alternative winner will be selected at random in accordance with the procedure set out above.
Prizes are awarded at our discretion and no prizes will be awarded as a result of improper actions by or on behalf of an entrant. An improper action for these purposes will include the making of automated bulk entries.
No alternative prize will be given & the prize is non-transferable & non-exchangeable. However, we reserve the right to change the prize due to circumstances beyond our control or to offer an alternative of similar value.
It is your responsibility to pay any & all applicable taxes on prizes.
We reserve the right to verify your eligibility & to check your identity. If you have been asked for proof of your identity &/ or your eligibility, your failure to provide such proof within a reasonable time could result in your disqualification from a competition or the withdrawal of any prize. All personal details & information you supply must be truthful and accurate.
We reserve the right to disqualify you from the competition &/ or withdraw any prize should you at any stage supply any untruthful, inaccurate or misleading personal details & information or if we consider you have breached these terms and conditions or the rules contained in the Competition Notice.
If an entrant is disqualified from a competition, it will be at our discretion to decide whether a replacement will be selected. If we decide to select a replacement, the replacement will be chosen using the same selection procedure as the original entrant and will be subject to these terms and conditions.
7. How do I enter by mobile text and how much does it cost?
Where we offer you the chance to enter a competition using a text message, we will do so on a reverse-billed premium rate basis and charge you on a per-message basis. This means that you first have to send us a text, which you will pay for sending at the normal per-message charge of your mobile phone provider.
Then, we will send you back one or more text messages acknowledging receipt of your first text and providing you with information about how to enter whatever competition it may be. You will be charged for all of these text messages even though we send them to your phone. This is what is meant by "reverse billing".
The cost of the acknowledgment/confirmatory texts that we send back to you will be made clear to you on each occasion that you enter one of our competitions. However you also need to remember that your mobile operator may add its own costs to this and so the total cost to you may go above the cost stated by us.
8. What if it is not my phone or I do not pay the bills?
You should always get the permission of the person who pays the bills before you use a phone (mobile or landline) to enter a premium rate service.
9. How do I enter by making a landline or mobile telephone call and how much does it cost?
Again, we will tell you how much we will charge you for a call from your ordinary landline telephone or from your mobile before you enter one of our competitions.
You should remember that when we state the cost for a landline premium-rate call, we have calculated the cost based on the standard telephone network charges of BT. It may be that your particular operator charges different prices on your telephone network and so you should check these to ensure that you are aware of the total costs that will be applicable to you.
Similarly, where we state the cost for a mobile phone premium rate call (or text messages for that matter) we do not include any costs that may be charged by your mobile phone operator and so you will need to check the charges levied by your provider to get an accurate figure for what the call will actually cost.
We remind you that calls from phone boxes are more expensive than calls from your home telephone.
10. Can I enter a competition by using my television red button and how much does it cost?
As a digital satellite television viewer you can enter certain competitions promoted on our channels by pressing the red button on your remote. If entry is available via red button, this will be stated in the relevant Competition Notice.
You should follow the instructions on the interactive application. You will pay the cost set out in the competition information. The cost of entry will appear on the telephone bill of the phone line used if you are a Sky subscriber. The entrant will be the Sky customer who is registered at the telephone number.
11. What if my entry is lost or damaged?
If we do not receive an entry from you for any competition then we cannot enter you, regardless of whether you sent the entry to us. Also, if we receive an entry from you that is illegible or incomplete or otherwise deficient we may not be able to enter you. We will not accept proof that an entry was sent as proof that we received it.
12. What are the rules about me supplying content?
If it is the case that a competition asks you to supply any content - whether it be pictures, text, sound recordings or whatever - the content you supply must comply with the following rules: (a) it must not be obscene, abusive, offensive or racist and it must not promote or propose hatred or physical harm against anyone; (b) it must not harass or bully another person; (c) it must be true and honest so far as you know; (d) it must not be defamatory of anyone; (e) it must not use the material or content or infringe the rights or privacy of anyone else: for example you should not use images of well known characters or music; (f) it must not contain someone else's personal details or confidential information relating to other people; (g) it must not promote or condone terrorism, violence or illegal behaviour.
We reserve the right to refuse to accept or refuse or cease to use any content supplied by any person that we think contravenes these rules.
If you are the winner of a competition you agree that you will allow us to use your name and picture in marketing and publicity undertaken by us, which may be in more than one country and which may be in a number of media, for example, print, television, internet. We will pay your reasonable expenses if we need you to make yourself available to be used in marketing and publicity of this sort.
13. What can we do with any material you send us and Intellectual Property Rights?
In consideration of us agreeing to consider you for a competition, you hereby assign to us full copyright and all other rights in your entry. This lasts for the full period of copyright and you agree that you will help us by carrying out anything required by us to give effect to this clause. We shall be free to assign such rights to third parties. We may use and/or exploit your submission as we like (although that doesn't mean we have to at all).
We will use any pictures, text or sound recordings that you send to us for the purpose of operating the relevant competition.
We may also use it for the purposes of promoting our business (for example by putting it on our television channels, mobile services and websites).
14. How will we use your personal details?
We will use your personal details to operate the competition that you are taking part in. Where we or other companies in our corporate group want to use your personal details for other purposes (such as marketing) we will offer you the opportunity to agree or to refuse this.
Your personal details will be treated in accordance with our Privacy Policy from time to time and in accordance with the law as it relates to people's personal details.
This takes you to our Privacy Policy (for those requesting a copy of these Terms and Conditions by post, you will also be sent a copy of the Privacy Policy).
15. How far are we liable or responsible to you?
Nothing in these terms and conditions removes or limits our liability for fraud, for death or personal injury caused by our negligence or for any liability which cannot be limited or excluded by the law. These terms and conditions also do not affect the rights that are granted to you as a consumer by the law. Otherwise, we will not be liable to you for any matter relating to the competitions offered by us.
We will also not be liable to you if you suffer loss or inconvenience because of the failures of persons or systems that we do not directly control - for example, mobile phone network operators, internet service providers, software providers and telephone traffic handlers.
16. The legal position of these terms and conditions
These terms and conditions form a legally binding agreement between you and us. We reserve the right to change them and update them from time to time but if we do so we will post the changes on this websites.
These terms and conditions shall be governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England, Wales, Scotland and Northern Ireland.
